OPS. Clothing, located at Dennenlaan 26, 5263 NR Vught, the Netherlands,  is responsible for processing the personal data as reflected in this privacy policy. 

OPS. Clothing cares about your privacy. We therefore process only the personal data that we need to run our web shop, to provide and improve our services and we are careful with the information that we have collected about you and your use of our services. 

This privacy policy applies to the use of the website and the associated services that OPS. Clothing provides on it. The effective date for the validity of these conditions is December 6th, 2021. Publishing a new version invalidates all previous versions. 

This privacy policy describes which data we have collected about you, what these data are used for, and with whom and under which conditions these data may be shared with third parties. We also explain how we store your data, how we protect your data against misuse, and your rights relating to the personal data you have provided to us.

ABOUT THE DATA WE PROCESS

The categories of personal data we process, how we process them, where we process them or cause them to be processed, and who can access them are set out below.

  • CATEGORIES OF PERSONAL DATA 
  • Here is a list of the personal data we process or cause to be processed:

    • first name and surname;
    • gender;
    • address and town/city;
    • telephone number;
    • email address;
    • data about your size and preferences;
    • financial data, such as your bank account or credit card number.

     

  • SPECIAL AND/OR SENSITIVE PERSONAL DATA
  • Our website and/or service does not intend to collect data on website visitors who are younger than 16, unless they have consent from their parents or guardian. However, we cannot check whether a visitor is older than 16. We therefore recommend that parents be involved in their children’s online activities to prevent data being collected about children without parental consent. If you are convinced that we have collected personal data about a minor without such consent, please contact our contact person and we will delete this information.

  • ANONYMISED DATA
  • Data that our website collects anonymously are processed with the aim of further improving our services. These data (for example, your IP address, internet browser, and operating system only) are not personal data. The website only uses functional cookies for which no consent is needed.

  • THIRD PARTIES
  • WEBSHOP SOFTWARE

    We have developed our webshop with software from Shopify. Personal data that you provide to us for our services are shared with this party. Shopify has access to your data to provide us with technical and other support; they will never use your data for another purpose. Shopify must implement appropriate security measures under the agreement we have concluded with them. All the safeguards mentioned in this privacy policy about protecting your personal data also apply to the services of third parties that Shopify uses.

    PAYMENT PROCESSORS

    We use payment platforms to process some or all of the payments in our webshop. These platforms process your name, address, town/city, and your payment data, such as your bank account or credit card number. They have implemented appropriate technical and organisational measures to protect your personal data.

    DISPATCH & LOGISTICS

    When you place an order with us, it is our job to deliver your package to you. We use the services of external carriers to make deliveries. It is therefore necessary for us to share your name, address and town/city with these carriers. The carrier uses these data only for the purpose of performing the agreement. If the carrier uses subcontractors, it also provides your data to these parties. All the safeguards mentioned in this privacy policy about protecting your personal data also apply to the subcontractors that the carrier uses. 

    PURPOSE AND BASIS OF DATA PROCESSING

  • GENERAL PURPOSE OF PROCESSING
  • We use your data solely for the purpose of our services as described above, including:

    • making contact after a contact request; 
    • preparing offers and agreements;
    • performing the concluded agreement; 
    • delivering our products or services;
    • invoicing and administrative purposes; 
    • notifying you of changes to our products or services;
    • sending the newsletter; and/or
    • optimising, improving and securing the operation of the webshop and website.

    We do not use your data for targeted or other marketing unless you are an existing customer or we have obtained your consent to send the newsletter or other direct marketing. If you share data with us and we use these data to contact you at a later time – other than at your request – we will ask for your explicit consent for this purpose. Your data are not shared with third parties, other than as described above or to fulfil our administrative and legal obligations. These third parties are all bound to secrecy and data protection based on our processing agreement with them, an oath, or legal obligation.

    In certain cases, we may also have a legal obligation to share your data in connection with governmental tax or criminal investigations. In this case, we are compelled to share your data, but will oppose this within the available legal options.

  • LEGAL BASIS/BASES
  • In principle, processing your personal data is necessary for performing the agreement concluded with you. If processing your personal data is unnecessary for performing the agreement, we will ask for your consent to the data processing. In some cases, processing may also be necessary to comply with a legal obligation or to protect a general legitimate interest. In the latter case, we will always weigh up our interests against your privacy interest. 

  • RETENTION PERIOD
  • We do not retain your data longer than necessary. Under applicable legal requirements, we must retain invoices and financial or other administrative personal data for at least seven (7) years after recording them. We will thus retain these data for as long as the applicable period lasts. 

    PROTECTION OF PERSONAL DATA

    We take the protection of your data very seriously and implement appropriate measures to prevent misuse, loss, unauthorised access, unwanted disclosure and improper changes. To protect your personal data, we use security software such as a virus scanner and firewall, passwords for electronic systems, a secure internet connection, back-ups, and similar measures. If you feel that your data are not properly secure or there are indications of misuse, please contact our contact person.

    YOUR RIGHTS

    Under applicable Dutch and European legislation, you have certain rights as a data subject regarding the personal data processed by us or on our behalf. We explain these rights and how you can invoke them below. 

    You will receive all copies and reproductions of data in a commonly used electronic format or in writing, if requested. We will respond to your request(s) as soon as possible, but within no more than 30 days. We attach great importance to protecting your personal data. You can submit the following requests to us at any time and we will be pleased find a solution with you. You can submit your request(s) to our contact person. However, if you suspect that we are using your personal data improperly, you also have the right to submit a complaint to the Dutch Data Protection Authority. 

  • RIGHT OF ACCESS
  • You may access the data that we process (or cause to be processed) about you or that can be traced back to you. 

  • RIGHT OF RECTIFICATION
  • You may have the data that we process (or cause to be processed) about you or that can be traced back to you, corrected. 

  • RIGHT TO ERASURE
  • In certain cases you may have the data that we process (or cause to be processed) about you or that can be traced back to you, erased without unreasonable delay. If your request is granted, we undertake to delete all data we have collected about you. However, we must observe certain legal retention periods that may prevent the immediate deletion of these data. If these reasons affect the deletion, we will inform you accordingly.

  • RIGHT TO RESTRICTION OF PROCESSING
  • In certain cases you may restrict the data that we process (or cause to be processed) about you or that can be traced back to you. 

  • RIGHT TO DATA PORTABILITY
  • In certain cases you may have the data that we process (or cause to be processed) about you or that can be traced back to you, dealt with by another party. 

  • RIGHT TO OBJECT AND OTHER RIGHTS
  • Lastly, you may at any time withdraw your consent to data processing and in certain cases object to processing of your personal data by or on behalf of OPS. Clothing. If you object, we will immediately cease data processing and await the outcome of your objection. If your objection is well-founded, we will provide you with copies and/or reproductions of the data we process (or cause to be processed) and then permanently cease processing them. 

    You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. But if you believe we do, please contact our contact person.

    THIRD-PARTY WEBSITES

    Clicking on links from third-party websites displayed on our website or following the instructions given can subsequently lead to data collection. We have no control over data collected with or without consent through third-party advertisements or websites. We refer you to the privacy statements of these third parties’ respective websites. 

    AMENDMENTS TO THE PRIVACY POLICY

    We reserve the right to amend our privacy policy at any time. However, you will always find the most recent version on this page. If the new privacy policy affects how we process data about you that has already been collected, we will inform you by email.
